Preparation is underway for the presentation of evidence on May 10th, 2005. The SEC has requested a ruling from Judge Murray in advance of the hearing on any evidence of Naked Shorting of CMKX. The SEC contends that evidence of Naked Shorting is immaterial and irrelevant. This will be a case of first impression. Judge Murray will respond prior to the start of testimony to the SEC's request. CMKX never mentions they are enquiring about a NSS they just want all the records of sold, borrowed, outstanding borrowed shares etc. So the arguement to the judge is, your right NSS doesnt have a place, but we need the records to reconcile info and file accurate information. But judge could we ask the SEC why they feel there is a NSS position? SEC knows there is a NSS position and very well may have just jumped the gun and exposed their very motive....trying to cover up the NS position. They bit hook line and sinker....way to go CMKX.
