1. My broker is telling me it is a 4-6 week turn-around time for certificates, what will happen if I miss the deadline and what can I say to get my broker to get me my certificates in time?
There has been no official extension from the Task Force of any deadlines. You simply do not know if there will be any further extensions. The Task Force wants to know who you are and will make every effort to include you in the final distribution. The Task Force is well aware there are many shareholders in the same boat you are. The Task Force believes there should be every effort made to help the shareholders obtain their certs. They are considering seeking the help of the Courts to resolve the problems you are experiencing. The transfer agent has told us she can return your cert to your broker in a matter of days once it is requested by your broker. We are very concerned when we hear a shareholder was told it will take weeks to obtain their certs.
2. What is the distribution ratio so I will know if it is worth me paying to order my certificates?
There is no official distribution ratio. We have not received certs from many shareholders of the company so we do not what the final distribution ration will be. Say simply we are not allowed to guess or speculate on what any final distribution ration will be.
3. Why won’t you just accept my brokerage statement?
The company has received communications from hundreds of shareholders saying their positions have been wiped out of their accounts. We have also learned through records from the SEC that there are billions of “fails to deliver” in this stock. That means that brokers have told their customers they have valid shares, but the broker has not been able to locate those shares. So, the customer may not really have valid shares even though they get a statement each month from their broker. Because of these massive “fails to deliver” and the actions of some brokerage houses cleaning out CMKM shares without the permission of their customers, the company believes it would be liable if it distributed these shares without confirming actual ownership of real shares.
4. My shares are in an IRA or company sponsored retirement account and my broker tells me that he cannot get me a certificate for my shares because he has no way to do it?
If your broker refuses to give you a certificate upon your request, then you may have rights against your broker. This office cannot advise you of your rights in this regard. You should contact an attorney of your choosing and discuss these matters. It is a very simple matter for a brokerage firm to obtain a certificate in the broker’s name as custodian for you. We have received hundreds of certs which contain a shareholder’s name and the IRA or other retirement account information on the cert. (i.e. Ameritrade as custodian of Mary Jones IRA account) You do not need physical possession of your cert. You need a copy of the cert that your broker is maintaining for purposes of your account. The cert will have a cert number and we can verify its authenticity with the transfer agent. The broker can fax it to this office or can send it to you and you can then fax it to this office.
5. What if my broker sold or liquidated my shares without my consent or knowledge?
On November 3, 2005 the company sold a major asset of the company to Entourage Mining Ltd. for 45 million shares of Entourage stock. This stock is currently trading under the symbol ETGMF. Entourage has announced through press releases that it intends to develop the claims once owned by CMKM. The company knows of no reason for a broker to liquidate the shares of CMKM stock from a brokerage account. Because of these activities, the company feels compelled to demand certified shares as proof of ownership. You should notify the CMKM Task Force of the particulars of your account situation. Many hours were spent compiling the list that was sent to the mailout company. Several different Nobo/Obo lists which were obtained by the company from ADP services were added together and information from the transfer agent was also taken into consideration. The Task Force made every effort to eliminate the names of those that have already obtained a certificate in their name. Much time was spent trying to eliminate the duplication of names because were using lists that had duplicate names. If you received a card in the mail and you have already sent your certs to the Task Force then you simply did not get deleted from the mailing list before it went to the mailout company. It does not mean that we do not already have your information. Feel free to go to the site we have created which shows the cert numbers included in our data so far. If your cert number is found, then your information has been received. If not then contact us.
