MACH!!!! great point buddy...There are a few lines from the pr that have been in question, besides the obviouse questioning of the O/S and Float...this line is also very interesting:
"CMKX has not been provided a waiver, "variance" or any other relief by the SEC for complying with the 60-day requirement. In fact, due to the overwhelming number of reports that need to be filed, coupled with the necessary financial statement preparation, CMKX will not be able to comply with the 60-day requirement."
The company is blatantly stating that we will not make the 60-day req. It is pretty much agreed by everyone that once the deadline is up...and CMKX has not filed the req info...then CMKX will no longer be trading and the co will be gone. Now why would Maheu and the co put a statement like this out so early. They knew the day would come where they would have to file all old and new information. So why would they not be getting prepared for that day with all the time they have had. They could probably still have enough time, if they started right now and worked 24-7, to get all of this paperwork (or at least the majority of it) done and filed. So why would they make a statement like this?
ENTER CIM or SGGM: I think you hit the nail on the head saying that "CMKX" won't file, but there will be a merger into another company such as CIM or SGGM...or something along those lines. In any event...I believe you are dead on with your idea about CMKX merging into another company and just disapearing all together. I am sure if this is the plan...then we will get some decent return from our CMKX shares before they are gone forever...as you would have many upset shareholders selling there "new shares of CMKX" right away if we were told that we would see nothing from holding old CMKX shares this entire time. And that is not how you want to start a new company.
We could post for days and days on different theories about how this could all go down, but I do believe you brought up a very very good point in that we will see CMKX merge into some other company and then we will take it from there. Great theory MACH...enjoy your weekend buddy.

With its reporting status reinstated, CMKX anticipates filing a number of SIGNIFICANT CORPORATE UPDATES with the SEC in the upcoming weeks on Form 8-K."
Much easier to file under new name after merger. EX. IF CMKX is bought by CIM, the only information that is required is that information that CIM desires, NOT THE SEC. Once the merger is completed and IF CIM wishes to become trading, it, CIM, must file and all past CMKX filings are not needed because that entity is gone.

The Casavant Plan...
Last month I put a post out about merger possibilities. In the post I said it could be changed as the story and My DD changed. I still believe most of the post is valid.

I believe there is a large short, Urban is holding a large portion of the shares in cert form IMO. The dividends last year were payed to all of the naked shares. What is going to happen when Urban shows the SEC the shares he holds in cert form and tells them dividends are owed on those shares. The DTC and brokers would not of known about these shares Urban holds. The short will be proven conclusivly.
It now appears Urban will take the company private IMO. Look for a buyout in the .05 range, depending on negotiations. Then possible a merger with CIM. Shareholders would get the other 20 billion dividend shares that have not been issued in the transactions, possible free trading on an IPO.
I don't believe the stock will trade again. There will be OS clarification PR's as well as 8K's, that will tighten the noose. I don't believe the total size of this short will be known, it is too damaging to the market.
Where is the money going to come from for the buyout, look at CITI. They purchased NITE's derivitive business, (the entitiy that is suspected as one of the large shorters.)last year. CITI also sold 20-40 billion dollars worth of shares last year, where is all that money going to be used, hmmmmmmm. CITI has become more involved with the company over the last year.
Maheu is not playing around, he will continue to add pressure to get this resolved. The SEC will do the right thing to resolve this.
